Disclaimer for Online Loan Applications
I acknowledge that Royal-Kredit GmbH (hereinafter referred to as the “Mediator”) forwards my application for review to Cembra Money Bank AG, Bank Now AG, bob Finance AG, good finance AG, cashare AG, creditgate AG, Cornèr Bank AG, Credaris AG, and other financial institutions via the Internet, email, or fax/post. Furthermore, I acknowledge and confirm the following:
Application Review and Credit Information Data:
I confirm the completeness, timeliness, and accuracy of all my details provided in the application and authorize the financing institution to obtain information about me from third parties, including banks, the Central Office for Credit Information (ZEK), authorities (e.g., debt enforcement, land registry, and tax offices, residents’ registration offices, child and adult protection authorities), credit agencies, credit intermediaries, employers, affiliated companies of the financing institution, and, if necessary, the Information Center for Consumer Credit (IKO) in connection with the review of this application and the execution of the contractual relationship. For these purposes, I release these parties from banking, postal, official, or business confidentiality. I acknowledge that the financing institution may be required to report a consumer lease/consumer credit to be granted or already granted to the Information Center for Consumer Credit (IKO). I also authorize the financing institution to notify the ZEK about the requested transaction and, where legally required, to report to other authorities. Such reports include, in particular, the type, amount, and terms of the credit/financing as well as the personal details of the applicant(s) and, where applicable, qualified payment defaults or misuse. I acknowledge the right of the ZEK to provide its members with information about the reported data. The financing institution may reject the application without providing reasons.
Collaboration with Intermediaries:
I acknowledge that the financing institution may exchange the necessary information related to the application/creditworthiness review, contract conclusion, and execution (e.g., parameters and results of the application review, delivery of contract documents, information on contract status and payment behavior, and balance) with the intermediary for applications received through intermediaries. To this extent, I release the financing institution from banking secrecy, as necessary and permissible.
Details about Partners:
If I have provided details about my spouse/registered partner (“partner”) in the application, I confirm that (i) I have informed my partner about this application, (ii) the financing institution may verify the provided details by direct inquiries with my partner, and (iii) my partner agrees that the financing institution may collect information concerning them as described above (including conducting information inquiries with the ZEK).
Data Processing:
I acknowledge that the financing institution may process my data for the purpose of reviewing my application as well as for risk assessment and marketing purposes (data analysis and profiling). Additionally, other products and services, including those from group companies of the financing institution and third parties, may be offered to me via post or phone. I may object to the processing of my data for marketing purposes at any time. By providing my email address, I also agree that the financing institution may send me the aforementioned offers via email. I expressly accept the risks associated with open communication via email, including the possibility that my data may be intercepted or disclosed by third parties during transmission, or that unauthorized third parties may infer a contractual relationship between the financing institution and myself. As a result, confidentiality protection and banking secrecy may not be guaranteed. I may revoke my consent to the electronic delivery of advertising at any time.
Collaboration with Service Providers (Outsourcing):
I acknowledge that the financing institution may outsource services, particularly in the areas of business process management, IT security and system control, market research and processing, the calculation of business-relevant credit and market risks, as well as the administration of contractual relationships (e.g., application and contract processing, collections, customer communication) to third parties (“service providers”). The financing institution provides these service providers with the data necessary to fulfill contractual obligations and may also transfer this data abroad. Service providers, their employees, and subcontractors are contractually obligated by the financing institution to maintain confidentiality. Service providers are typically located in Switzerland or the EU/EEA area but may also be based anywhere in the world. If personal data is transferred to a country that does not provide an adequate level of data protection from the perspective of Switzerland, the financing institution ensures appropriate data protection through suitable guarantees, such as the agreement of standard contractual clauses.
I acknowledge that communication between the financing institution and myself or the intermediary may occur via electronic channels. The intermediary and the financing institution cannot guarantee the confidentiality of data during transmission over the Internet. Third parties may infer the existence or forthcoming establishment of a business relationship (potentially a banking relationship) between myself and the financing institution.

Credit granting is prohibited if it leads to over-indebtedness (Art. 3 UWG).
